Why should Kevin Smith explicit say that it is a reference? He uses so many refences in his movies that it does not seem to make sense to state each one of them. It is clearly a Last Crusade reference and to me it was used very fitting. He did not hide the joke or change it somehow. He definitly did not steal it.
