Your point about Indy's attire being based on real clothing says it all. To my knowledge Lee does not use the name 'Indiana Jones', or 'Raiders of the Lost Ark' on any of his stuff. Joe (Peters) may have a problem due to the fact that he specifically designates his fedoras as 'Custom Indiana Jones hats'. And Flight Suits has gotten WAY, WAAAAYYY to ballsy with their description. My suggestion to anyone currently offering, or planning to offer 'Indy' stuff would be to describe these things as "Indy-like", or "Indy-esque". Avoid directly using the name 'Indiana Jones' or the film titles.
